WCU to offer 'Electronic Records and Employment Law' Nov. 20
10/22/2008 - Western Carolina University will offer “Electronic Records and Employment Law” from 9 a.m. to 12:30 p.m. Thursday, Nov. 20, in Room 143 of the Cordelia Camp Building.
Instructor Jonathan Yarbrough will discuss the preservation of electronic documents and their legal implications in the workplace.
“The ‘e-discovery’ amendments to the Federal Rules of Civil Procedure provide for discovery of electronic information, including e-mails, electronically stored files such as those in Word or Excel, and instant messages,” said Yarbrough. “A document is a document and electronic records must be maintained for discovery purposes.”
The workshop also will address the use of social networking Web pages, e-mail policies, instant messaging and text messaging in the workplace.
Participants will identify electronic records that may be applicable to employment law, learn protocol for preservation of records and the importance of the Zubulake instruction, a Federal Court decision that increases the pressure on employers to preserve electronic information.
Yarbrough is an employment attorney practicing with the national labor and employment law firm of Constangy, Brooks & Smith, LLC, in Asheville. He also writes columns for the Asheville-Citizen Times about the legal pitfalls of managing people.
Early registration is $69, prior to Nov. 10. After Nov. 10, the cost will be $89. Discount group rates are available.
